Service Description

MTN Nigeria Communications Limited (the Organizer) and Upstream Mobile Commerce Limited (the Provider) will launch a new Top up Rewards program (the Program) exclusively for the Organizer’s customers. The Program gives the Organizer’s customers the opportunity to participate in draws for various prizes.

1.1. The Program consists of 4 levels:

  • Top up rewards (Free level) – MTN subscribers who top up and send the communicated Keyword become participants and can collect points by topping up and by answering to questions on trivia game points. Points accumulated correspond to entries to draws for various prizes.
  • Premium Trivia Service: Premium Trivia Game under daily subscription cost of N100 (inc. VAT), involves a set of questions and answers. Participants can compete for Premium Level Prizes.
  • Premium Loop (Celebrity Content): Premium celebrity content-Davido-under daily subscription of N50 (inc. VAT), involves local celebrity content such as Never-before-seen material & direct feed from top celebrities. Content will be available over a mobile app, web based or SMS based depending on the user device. Subscribers can compete for prizes for a limited period (Program period). Subscribers to the service will continue enjoying the service even after the end of the Program Period.
  • Premium Fitness clues (content service): Premium fitness clues under a daily subscription of N30 (inc. VAT), offering fitness information via SMS and a mobi-site that offers rich content. Subscribers can compete for prizes for a limited period (Program period). Subscribers to the service will continue enjoying the service even after the end of the Program Period

1.2. Members of Top up rewards will be prompted to subscribe to any of the premium Services while interacting with the Top up rewards.

1.3. “Direct-To-Premium” registration to any of the premium legs can also happen when a user sends a specific dedicated keyword to the Premium Service’s short codes.

Program Duration

2.1. The Program will have a duration of 100 days. The start date will be on 16th March, 2017 local time and the end date will be on 31st May, 2017 (the Program Period). The organizer reserves the right to shift the start and end date by one or more weeks.

2.2. The program may be extended beyond the end date.

Registration and Cancellation

3.1. To become a Top-up rewards member, an MTN subscriber needs to send the advertised Keyword e.g. FREE, to the shortcode9004 for free. Any SMS sent to the shortcode 9004 (specific keywords will be communicated), apart from special commands, will be considered as the user’s request to join Top up rewards according to these Terms & Conditions.

3.2. To become a Premium Trivia ServiceParticipant, an MTN subscriber needs to send the advertised Keyword e.g. VIP to the shortcode9005 for free. This Keyword sent to the shortcode 9005 (specific keywords will be communicated) will be considered as the user’s request to join the Service according to these Terms & Conditions.

3.3. To subscribe to the Premium Loop (celebrity content), an MTN subscriber needs to send the advertised Keyword e.g. OK shortcode 38425 for free. This keyword sent to the shortcode 38425 (specific keywords will be communicated) will be considered as the user’s request to join the Service according to these Terms & Conditions.

3.4. To subscribe to the Premium Fitness Clues (Content Service), an MTN subscriber needs to send the advertised Keyword e.g. FIT the shortcode 38428 for free. This keyword. Any SMS sent to the shortcode 38428 (specific keywords will be communicated) will be considered as the user’s request to join the Service according to these Terms & Conditions.

3.5. A Free Level Participant can also subscribe to the Premium Level by replying to specific SMS advertisements at specific steps of the free trivia flow with a dedicated keyword communicated via the shortcode 9004.

3.6. Registration will be available over USSD, dialing the following:

  • Top up rewards (free leg) - *669*1#
  • Premium Trivia Service - *669*2#
  • Premium Loop (celebrity content) - *669*3#
  • Premium Fitness clues (content service) - *669*4#

3.7. Additional registration methods may be used but user registration consent will always be requested.

3.8. Members of the program may unsubscribe by sending a free-of-charge SMS with the following Keywords:

  • Top up rewards (Free level) – STOP FREE to 9004
  • Premium Trivia Service: STOP VIP to 9005
  • Premium Loop (content service): STOP OK to 38425
  • Premium fitness clues (content service): STOP FIT to 38428
  • STOP will automatically remove you from the program (all legs of the program)
  • Customers who join the program are considered members of the specific service(s) they subscribe to until they cancel their subscription.

3.9. Cancellation can be made by calling MTN Call Center number – 180, and asking for unsubscription.

3.10. Cancellations may occur at the Organizer's sole discretion in the event a clear expression of non-interest in participating to the program is demonstrated by the Participant via SMS communication (e.g. the Participant is sending an MO message reporting “I do not want to participate”) even without having used any of the above mentioned methods of cancellation (2.7, 2.8).

3.11. Participants who cancelled their subscription can re-register at any given point in time during the Program by sending the defined registration keyword(s) to the dedicated short codes for any of the levels.

3.12. The Organizer reserves the right to cancel or amend the Program and these Terms and Conditions at any time. Any changes will be posted online at the Organizer’s website.

Subscription Charges

4.1. The daily subscription charge for Premium participants are as follows, (incl. Tax).

  • Top up rewards (Free level) – FREE
  • Premium Trivia Service: N100/day
  • Loop (Celebrity Content): N50/day
  • Fitness clues content service: N30/day
  • Every day, paid level users are charged via the daily billing cycle that runs while a subscription is active.
  • For accessing the mobisite of Fitness Clues service or downloading the Celebrity app, standard data rates may apply

4.2. All other interactions with the program are free of charge.

4.3. The Organizer may offer any of the Premium services at its sole discretion at a discounted rate.

4.4. In case of repeated unsuccessful charges, Premium Level Participants may be removed from the Program.

Interacting with the Program

5.1. Top-up rewards

5.1.1. Upon becoming a member of top-up rewards the user will receive a welcome message and a message with the first question of the day

5.1.2. From this point on members of Top-up rewards can progress to the different levels by collecting points by topping up and answering to questions

5.1.3. There is a cap of 6 questions which can be renewed upon top up by the participant sending the keyword FREE to 9004

5.1.4. Every SMS sent and received from in Top-up regards is free of charge

5.1.5. Subscribers can leave top-up rewards at any point as per 4.8

5.1.6. User who has not performed any top up event throughout the Top Up Reward Program, will not be allowed to register to the Free Trivia Game. Instead, (s)he will receive a policy message in this case prompting him/her to perform a top up first.

5.2. Premium Trivia Service.

5.2.1 Upon registration to the service subscribers will receive a welcome message that welcomes the user to the serviceintroduces the Premium Trivia/ Services, premium prizes and any required legal information.

5.2.2 Upon successful charge he will receive a charge notification and the first question of the day.

5.2.3 Every day, upon successful charge, a subscriber can play up to 5 trivia questions.

5.2.4 Every day there will be an attempt to charge the service subscriber. If the charge is successful he receives the first question of the day.

5.3. Premium Loop.

5.3.1. Upon registration to the service users will be able to access the application by:

  • Downloading the app from google play
  • Accessing the web based loop platform (HTML5)
  • Receive the SMS based content

App and Web based

5.3.2. Upon registration user will receive a welcome message and legal message

5.3.3. They will also receive the link to download the app or access the web portal and all other legal information and the pin to access the web page and app

5.3.4. Upon successful charge users will receive some initial info plus the link to access the web page or app for more information

5.3.5. Every day there will be an attempt to charge the user. Upon successful charge user will receive content as per 5.3.4

5.3.6. In case of insufficient balance users will get limited access to the app or webpage and access to some sections will be restricted

5.3.7. Use of the application and webpage is subject to data charges

5.3.8. The uninstallation of the app, does not translate to exit from the service. If the subscriber wishes to unsubscribe, (s)he will have to follow the standard approach via SMS, i.e. send the dedicated cancellation keyword to the service shortcode

5.3.9. Upon registration users will receive the welcome and legal message

5.3.10. Upon successful charge users will receive the content of the day

5.3.11. In case of insufficient balance users will not receive the content

5.4. Premium Fitness Clues.

5.4.1. Upon registration to the service subscribers will receive a welcome message that welcomes the user to the serviceintroduces the Services, premium prizes and any required legal information.

5.4.2. Upon successful charge he will receive the content of the day plus the link to the mobisite.

5.4.3. Every day there will be an attempt to charge the service subscriber. If the charge is successful he receives a text based content of the day plus a link which will direct the user to a new article every day, relevant to the text based content he/she has received.

Additional Capabilities

6.1. Participants can get more information about the Program or the respective service by sending “INFO” to the dedicated shortcode.

6.2. Participants can get their last unanswered free trivia question from the Free Level, for free by sending “LAST” to 9004.

6.3. Participants can get their last unanswered premium trivia question of the day from the Premium Trivia Service, for free by sending “LAST” to 9005.

6.4. Participants can get to know their points in the respective draw(s), for free by sending “POINTS” to the dedicated shortcode.

6.5. Participants can retrieve their mobisite or app credentials for Fitness Clues and Celebrity service, for free, by sending “PASSWORD” to the shortcode 38428 and 38425 respectively.

  • The higher the loyalty level, the more, and higher-value, the prizes the Participant is eligible for. For example, a loyalty level 4 Participant is eligible to win the free prize of all levels 1, 2, 3 and 4 while a level 2 Participant is eligible only for level 1 and 2 prizes. Table follows:

  • The frequency size of top up amounts and top-up medium used may be incentivized by rewarding special points from time to time. Participants will be informed of such incentives and the corresponding special points during the course of the program.
  • Special points to participants in the free trivia game may be offered through special contests, such as “happy hour” – in which all correct answers within a specific time/day attracts special points.
  • The prize title reports the corresponding economic value of the prize which will be given, which can be money or goods value as part of the Prize Pool (e.g. a Generator at N140,000).
  • Weekly Prizes Period is defined as 7 days period, starting from 00:00:00 of the Program day launch. Thus, Weekly Period #1 will last from 00:00:00 of Program Day #1 and will terminate at 23:59:59 of Day #7 of the Program Period.

7.2. Premium Trivia:

  • Participants will be charged a daily subscription cost of N100 (incl. VAT) until a user selects to unsubscribe
  • Users might be prompted to enter directly via the shortcode 9005 (or *699*2#) and without having entered the Top Up rewards (free leg).

7.2.1 Each Point earned equates to one draw entry.

7.2.2 Points are cumulative through the duration of the promotion within the specific service.

7.2.3 To qualify for a particular draw, PARTICIPANTS must have incurred one premium charge from the short code (9005) during the particular draw period.

  • Weekly draw - one charge on any day of the week of a weekly prize period
  • 100 day draw- one charge on any day of a quarterly prize period

7.2.4 A participant enters into the relevant draw with the specific amount of points for each leg, that he/she has earned throughout the Premium Trivia service until the end of the relevant draw period (e.g. at the end of the week).

7.2.5 Participants may only win one prize per prize category.

7.2.6 Premium Content services (Loop): Subscribers to the Service will be charged with a daily subscription fee of N50 (incl. VAT) until they select to unsubscribe. Users may be prompted to enter the Service directly via the shortcode 38425 (or *699*2#) without having entered the Top Up rewards.

7.3. Premium Content service (Fitness): Subscribers to the Service will be charged with a daily subscription fee of N30 (incl. VAT) until they select to unsubscribe. Users may be prompted to enter the Service directly via the short code 38428(or *699*4#), even without having entered the Top Up rewards.

7.4. At any time during the Program Period, the Organizer may introduce special challenges that offer the Participant bonus points. Special challenges samples: answering X questions correctly in a row, answering Y questions correctly within a timeframe, bonus points for correct answers within a timeframe etc. Successfully completing a challenge will award bonus points to the Participant.

7.5. Points are cumulative across Prize Periods.

7.6. Points are not cumulative across different services. Each Service is independent of each other in terms of point accumulation and prizes.

7.7. Prizes must be accepted as awarded, cannot be exchanged for other prizes or cash different from the ones provided within the Prize Pool, and may not be transferred or exchanged. Prizes will be delivered within 120 days from the end of the Program Period, at a time and place that will be made known within 30 days from the end of the Program Period.

Eligibility Rules

8.1. The Program is open to residents of Nigeria that are subscribers of the Organizer, excluding all employees, representatives and agents of the Organizer, their respective parents and/or affiliated companies, contest suppliers, and those with whom any of the foregoing are domiciled. The person that owns the SIM card or has express authorization from the SIM card’s owner to use it is considered the Participant, regardless of the actual user of the phone.

8.2. In order to be eligible for the Free Prize Level, a Free and a Premium Level Participant needs to have collected at least 1 point during the corresponding Prize Period.

8.3. In order to be eligible for the Premium Prize Level, a Premium Level Participant needs to have collected at least 1 point during the corresponding Prize Period via subscription.

8.4. Prizes for each level are independent of other levels.

Winner selection, notification and prize forfeiture

9.1. Prizes will be assigned by draw. A draw will be held, in which the specified number of winners will be randomly selected from all eligible entries. Each eligible Participant will be allotted a number of entries equal to the number of points he has accumulated by the end of the Prize Period.

9.2. Every draw will identify a winner and 10 runners up, which will be entitled to become the winners in the event the first selected will not comply with all the eligibility criteria.

9.3. Every winner will be contacted by the Organizer on the mobile phone number he has used to participate in the Program. The Organizer will attempt to contact the winner at least 3 times a day over a period of 1 week, between the hours of 9am and 8pm. If the winner cannot be contacted during this period, he is disqualified and forfeits the prize and the Organizer will attempt to contact the next runner up.

9.4. The winner is required to provide proof of eligibility and sign a prize acceptance form (as requested by the Organizer) before prizes can be collected. If the winner fails to provide sufficient proof within that period, he is disqualified and forfeits the prize and the next runner up is contacted.

9.5. If the winner has any outstanding debts towards the Organizer, these need to be settled within 3 days from being contacted by the Organizer. If outstanding debts are not settled within that period, the winner forfeits the prize.

9.6. If a winner fails to redeem his/her prize within 2 weeks from the date of contact, the first substitute will be selected to claim the prize

9.7. If the winner and all runner-ups forfeit the prize, the prize is deemed unclaimed and remains at the disposal of the Organizer.

9.8. By accepting a prize, a winner consents to the use of his first name, initial of last name, city of residence, photograph and likeness in any promotional material produced by the Organizer. Such use does not entitle the winner to any further compensation.

9.9. Each Participant (physical person or MSISDN) is entitled to receive only one prize per prize category.

9.10. Any expense not explicitly indicated as part of the prize, including but not limited to insurance, travel expenses, accommodation, license fees or taxes, are the responsibility of the winner.

9.11. Participants must be at least 18 years old to participate.

Abuse and disqualification

10.1. Participants are not allowed to use machines that send automatically SMS messages or automate/facilitate the answer process or any other alternative of sending SMS messages, other than the mobile phone (this prohibits the use of any GSM modems attached to a computer or mobile phones attached to a computer). The ORGANIZER has the right to disqualify any PARTICIPANT under the suspicion of breaking this obligation

Organizer’s responsibilities

11.1. Organizer’s responsibility is strictly limited in giving the Prizes. The Organizer cannot be held responsible for any delay or impossibility of sending or receiving SMS messages because of a technical problem. All the SMS messages will be considered received by the Organizer when they are registered in the Program’s IT system and not when they are sent by the Participant. All the SMS messages will be considered received by the Participant at the moment they were sent from the Program’s IT system. Participants recognize and accept that the journal of the informatics system of the Program’s IT System is the proof of the date, hour, minute and second of their receiving/ sending each SMS message.

Personal Data Protection

12.1. By participating in the Program, the Participants expressly agree that personal data which they supply shall be processed by the Organizer for the purposes of executing the Program and also for the purpose of publicizing the Program and the Organizer. It is hereby specified that the Organizer guarantees that publicity, entailing the sharing with third parties of personal data supplied as a result of participation in the Program, (including through television, the press, leaflets and other means and formats of communication) shall be made only with respect to the winners of the Prizes and will only indicate the given names and surnames of the winners, the location of their place of residence, their images and voices (contained in photographic records, audio, video and other types of records, made with the purposes of publicity connected to the Program). The winning Participants give, through their participation in the Program, express consent for the use of this data in formats herein defined. Following the termination of the Program, the personal data will be destroyed.

12.2. In accordance with local laws and regulations, the Organizer respects the privacy of members of this Program, by which it is committed to the use of technology in a transparent form and in strict observance of the rights, freedom and guarantees of the citizens and by the reservation of the intimacy of their private and family life. The personal data collected within the scope of this Program will be treated as private and confidential. It shall not be disclosed to other individuals or organizations, except in the event of legislation to the contrary or where the Participants themselves authorize such. The data will be stored on servers with access controlled on a need-to-know basis and limited by passwords.

Governing Law & Amendments

13.1. This Program is organized under and governed by the laws and statutes of Nigeria.

13.2. These Terms & Conditions are valid during the Program Period until amended or suspended by the Organizer.
